TORTS CD 1 Research Paper Example | Topics and Well Written Essays - 250 words

TORTS CD 1 - Research Paper Example Should the teacher want to file a defamation claim, she should make sure she has enough proof for the defamation claim to be successful. The settled common law, requires that for a plaintiff to come up with a prima facie of defamation he or she has to show that the statements made against her are false, two she has to show proof of how the statement caused her harm and thirdly, she has to show proof that the statement was given without enough research into whether it was true. If she also thinking of bringing suit, she should be aware that there are potential pitfalls that she could encounter. For one, she should be aware that courtroom trials are costly and bearing in mind that she does not have a job; it would prove very expensive for her. In addition to this, it is also time consuming as the amount of time needed is time consuming. The lawsuit is also known to challenge the defendant and plaintiffs patience (Mesriani Law Group, 2011). In my opinion, a law suit is not the best approach since for one she might not have enough money to follow up with the suit till the end. Secondly, other that wastage of time which could be extremely frustrating, she should go through the facts of her case thoroughly because she may find that the standing of her case may not be as good as it may

The Romanesque churches And Gothic Cathedrals Period Essay

The Romanesque churches And Gothic Cathedrals Period - Essay Example In spite of the Gothic period coming after the Romanesque period, the two periods, however did not use similar elements in their architectural designs. The main ideology following the Romanesque churches and Gothic cathedral were the ideologies which were used in their construction. The age during the period was known as the middle ages and was synonymous with poverty. Due to the change in the way of life between these two periods, the architecture adopted also shared a number of similarities and differences. The ideology used in the construction of Romanesque architecture was based on centered on protection. An example is that during the period, monasteries served as shelters for relics and saints, hence the practices of the two groups serving as a basic purpose in the construction of different structures. On the contrary, architectural constructions adopted by the Gothic were big churches known as cathedrals. These buildings were designed with towers. The ideology behind such a des ign was to make the people believe further in a presence of an almighty being who were placed upwards towards divinity. The cathedral designed during the Gothic period was meant to symbolize the faith and dedication of the people towards their religion. Lastly, the spirituality practiced by individuals during the Gothic period was stronger as compared to individuals living during the Romanesque. The ideal majorly practiced during the middle ages period was one that was centered on classical background.

Into the Fray Case Study Example | Topics and Well Written Essays - 1000 words

Into the Fray - Case Study Example In my opinion, Danielle demonstrates the completely legitimate political behavior. After she has attempted to establish a professional relationship with Michael and upon his refusal and inaction, she has no reason to regard Michael as an ally. Still, the communication she has with Michael and his subordinates is straightforward by emailing and meetings proposals. The problem with political behavior is not with Danielle’s moves, but with Michael’s disregard of â€Å"social alliances that make an organization run†. Therefore rumors and interpretations make Danielle's behavior seem threatening and illegitimate. The only problem is that Danielle is acting and connecting to people in order to obtain the desired position, and Michael is not.First of all, Michael should decide whether or not he wants a career at Lafleur (Hassan). If he does, then his ambition should be long-term oriented and he and his family should judge as to what the best move for Michael is. If he r eally wants to develop in Lafleur, then he should take this opportunity seriously and discuss the personal implications with his family. Michael lacks international experience and the China position is an opportunity for him to develop his leadership abilities in networking and grow in the company. What is more, CEO’s proposition is only indicative that Michael is not the best candidate for Beaumont's place right now, but it also proves Pierre’s trust in Michael’s abilities and his desire to keep Michael motivated and within the company.

Literacy Narrative - Essay Example Writing is almost totally based on practice and research. Writing good texts is impossible without concentration, analysis and some basic sense of self-critique. But it is better to stop on each of my discoveries. With my first paper I faced the fact that having a topic and sitting with a laptop and a cup of coffee does not mean writing. It is then I understood that writing requires efforts and concentration. A good writer must create his work word by word stringing the beads. Distraction can cause loss of thought and that is why a person must make efforts to write. Only later much later writing becomes natural and the words start flowing. But I have to say that this principle is applicable to any sphere of human life: on the first stages you only try, fail, develop some skills and only then the process becomes easier and brings pleasure. Analytical thinking is another thing that is a must in writing. The pleasant bonus is that it is extremely useful in real life and writing helps to improve it. When creating my first texts I had to choose and assess arguments, ideas, and concepts from different sides and decide if they are relevant to my work or not. It was very difficult often to consider some theories and concepts that are both right but still are opposite. So it is challenging sometimes to have one stable opinion regarding something. So it is a writer who decides which facts are more important and more persuasive and which are irrelevant with the help of critical analysis. Analytical thinking is the ability to analyze information critically, to define relevant from irrelevant, to structure information in your own words. Several discoveries were not as pleasant as I wanted them to be. Speaking about structure it turned out that it can be another serious ordeal to clear perception of the text. I did not realize it for a long time and paid little attention to making text coherent and logical. Sometimes it was much easier to write everything

How has the solicitor's regulation changed in the UK Essay

How has the solicitor's regulation changed in the UK - Essay Example In this paper, a position is taken that the most effective form of change to regulation relating to solicitors can only achieve its intended purposes if the changes are comprehensive and holistic enough. In the light of this, changes that have taken place over the years by way of training system as well as regulatory structure governing solicitors are all subjected to critical review. There will also be a special review of the Human Rights Act 1998 to examine how it has impacted on the regulation of solicitors. The issue of self-regulation by the solicitors’ profession will also be reviewed. Training and ethics are two important phenomena in ensuring quality standard of practice by solicitors everywhere across the globe (Cooper, 2013). This is because through training, prospective lawyers are given the kind of education and professional nurturing, needed to ensure that they go about their duties as exceptional professionals. Meanwhile, a person’s individual ethical standards can also be a determining factor as to whether or not the person would heed to training instructions and practice professionally (Boon, 2014). To reconcile these two positions therefore, it is important that the training system for solicitors in UK will be structured in a way that ensures that only people who can be deemed as ethical individuals are admitted. Indeed many have questioned the importance of ensuring that admission for training for solicitors is based on only people who can be considered as ethical individuals. In response to this, Case (2013) observed that the law profession is a highly sensitive one, requiring strong and high standards of practice to ensure that a practitioner will hold fast to doing what is right. What this means is that lawyers have a lot of discretion in their practice as far as their actions are based on law. For this reason, it is

Frankfurt account Essay Example | Topics and Well Written Essays - 1250 words

Frankfurt account - Essay Example Human beings, however, can be said to possess second order desires with these desires, however, not being experienced by all people (Frankfurt 7). To my understanding, people who cannot use self-evaluation to validate their desire; therefore, deficient in second order desires, are referred to as wanton. According to Frankfurt, these second order desires are what distinguish a person from non-humans. Wantons or those without second order desires include small children, animals, and even adults who are not able to exhibit these desires. These non-persons are not bothered about will, and they do not have a care concerning where their life is going and how they could change it. In order to clarify the definition of a person, we can use the example of two child molesters. In this case, we can take the first child molester as having a first order desire to molest children given her affinity to do so, as well as having a second order desire that makes her desire to stop molesting children, although their urge may be uncontrollable. On the other hand, another child molester is in possession of desires in the first order that makes her molest children but is deficient in second order desires since she does not concern herself with what may happen if she is caught, which may lead to jail and embarrassment. For this child molester, who could care less concerning her will, her option of stopping the vile act and continuing the act are present in her mind, and none is more prevalent than the other is since she does not even attempt at evaluating her options. Therefore, she continues with what she does. Second order desires, to my understanding, then equate to a person being in possession of the will to carry out an action or not to carry out the action. If someone is not able to self-evaluate; therefore, not being in possession of desires of the second order, then they can be said to be deficient of will. In turn, they cannot claim to be persons according to Frankfurt, inst ead being considered as wantons (Frankfurt 6). While it is possible to understand where Frankfurt is headed with his argument, as well as where he is coming from, I disagree with the conclusion that a lack of will disqualifies someone from being considered a person. It is my belief that this someone still feels emotive, and exhibits feelings, even if they are vile characters like child molesters with no second thoughts about their actions and, therefore, to me at least, they are still persons. Early thought on the definition of a person held that, moral responsibility would be only applied to a person who commits a certain act if they had the chance to do something else. Throughout Frankfurt’s article, I found the inference to be that persons are not morally responsible for the acts they had committed when they had no chance to do something else. Frankfurt takes specific issues with this line of thought claiming, â€Å"our theoretical ability to do otherwise, he says, does n ot necessarily make it possible for us to do otherwise† (Frankfurt 10). The examples that Frankfurt assert to are important because they are suggestive of other ways that can be used to defend how determinism and moral responsibility can be compared, especially through the rejection of the argument’
